ROMA – Mediaset ricorre all’Antitrust contro la chiavetta Sky che da dicembre consentirà agli abbonati di ricevere l’offerta gratuita del digitale terrestre. «Mediaset – annuncia una nota di Cologno Monzese – ha presentato un esposto all’Autorità Antitrust in relazione alla Digital Key annunciata da Sky Italia. La distribuzione da parte di Sky di questa chiavetta, secondo Mediaset, è contraria alla normativa comunitaria e nazionale in materia di concorrenza e costituisce una violazione degli impegni assunti nel 2003 da Newscorp in occasione della concentrazione delle attività di Telepiù e Stream. Le norme antitrust, infatti, non consentono a un’impresa dominante di ostacolare l’ingresso sul mercato di concorrenti mediante vendite abbinate o aggregate dei propri prodotti». Per Mediaset, «il fine della Digital Key – che non consente l’accesso né ai servizi interattivi né ai contenuti a pagamento – è quello di frenare la diffusione sul mercato di decoder che consentano di ricevere i programmi a pagamento e i servizi interattivi di altri operatori. Il tutto evidentemente a danno dei consumatori che vedranno così limitata la loro possibilità di scelta a livello di offerta e di contenuti».
LA REPLICA – Da Sky arriva una replica all’iniziativa di Mediaset che indica anche quale sarà la «linea di difesa» dell’emittente di Murdoch. «Apprendo dalle agenzie di stampa – dice l’amministratore delegato Tom Mockridge, – del ricorso presentato da Mediaset all’Autorità Antitrust in relazione alla Digital Key di Sky. La Digital Key è una semplice iniziativa di Sky che garantirà a milioni di famiglie la possibilità di fruire dell’offerta in chiaro sul digitale terrestre in modo facile ed efficace. Si tratta di uno strumento che aiuta il processo di digitalizzazione del Paese offrendo un servizio per i consumatori in un mercato in veloce sviluppo. Uno sviluppo che, evidentemente, non è facile da accettare per un gruppo come Mediaset che per molti anni è stato, ed è ancora oggi, il principale soggetto privato operante in Italia nella televisione commerciale e dominante nel mercato della pubblicità».
CALABRO’ – Intanto, sull’altro fronte delle dispute legate alle varie piattaforme televisive – quello tra Sky e la Rai – è intervenuto Corrado Calabrò. Il presidente dell’Autorità per le comunicazioni, a margine di un’audizione alla commissione di Vigilanza, afferma che la Rai «dovrà stare su tutte le piattaforme tecnologiche, quindi anche sul satellite», così da consentire a tutti gli utenti di vedere le trasmissioni. E quindi «se Sky in una zona è indispensabile, la Rai deve starci nel periodo transitorio», limitandosi a criptare «proprio il minimo» delle sue trasmissioni. Il tutto nella fase di transizione che porterà entro il 2012 al digitale in tutta Italia. Durante l’audizione Calabrò ha affermato che l’Authority accerterà se la Rai – togliendo alcuni canali da Sky – abbia o meno oscurato zone e utenti: «Il procedimento è ancora in fase istruttoria, e poi ci sarà una valutazione degli organi collegiali».
